SalesHive Terms & Conditions

These Terms and Conditions apply specifically to the SalesHive CRM platform. For our general terms, please see our General Terms & Conditions.
1. Acceptance of Terms
By signing up for, accessing, or using SalesHive, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you are using SalesHive on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Service Description
SalesHive is a cloud-based Customer Relationship Management (CRM) platform that provides:
- Contact and company management
- Sales pipeline and opportunity tracking
- Email integration and communication tools
- Task and activity management
- Reporting and analytics
- Team collaboration features
- Third-party integrations
- Mobile and web access
3. Account Registration and Eligibility
3.1 Account Creation
To use SalesHive, you must:
- Be at least 18 years of age
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
3.2 Account Types
SalesHive offers different account types with varying features and user limits. Pricing and features are displayed on our website and may change with notice.
4. Data Ownership and Responsibilities
4.1 Your Data Ownership
You retain all ownership rights to the data you store in SalesHive, including customer information, contacts, and business data.
4.2 Data Controller Responsibilities
As the data controller, you are responsible for:
- Obtaining proper consent to collect and process customer data
- Ensuring compliance with data protection laws (GDPR, CCPA, etc.)
- Responding to data subject access requests
- Maintaining accuracy of data you store
- Using the platform in accordance with applicable laws
4.3 Our Role as Data Processor
SalesHive acts as a data processor, processing your customer data only according to your instructions and in compliance with our Privacy Policy and applicable laws.
5. Acceptable Use Policy
You agree NOT to use SalesHive to:
- Send spam or unsolicited commercial emails
- Violate CAN-SPAM Act, GDPR, or other anti-spam laws
- Store or transmit malicious code or viruses
- Infringe on intellectual property rights
- Harass, abuse, or harm others
- Collect data without proper consent
- Engage in fraudulent or illegal activities
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the service
6. Subscription and Payment
6.1 Subscription Plans
SalesHive offers various subscription plans with different features and user limits. You can upgrade or downgrade your plan at any time.
6.2 Billing
Subscription fees are billed:
- Monthly or annually based on your chosen plan
- In advance at the start of each billing period
- Automatically to your payment method on file
- In the currency specified at signup
6.3 Free Trial
We may offer a free trial period. After the trial:
- You will be charged unless you cancel before trial ends
- Trial terms are specified at signup
- One trial per customer/organization
6.4 Refund Policy
Refunds are provided:
- Within 30 days of initial purchase if not satisfied
- For billing errors or duplicate charges
- At our discretion for exceptional circumstances
- No refunds for partial subscription periods after 30 days
6.5 Price Changes
We may change subscription prices with 30 days advance notice. Existing customers will be notified before renewal at the new price.
7. Service Level and Availability
7.1 Uptime Commitment
We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced in advance when possible.
7.2 Support
Support is provided based on your subscription plan:
- Basic Plans: Email support during business hours
- Professional Plans: Priority email and chat support
- Enterprise Plans: Dedicated account manager and phone support
8. Data Backup and Export
8.1 Automated Backups
We perform daily automated backups of your data. However, you are responsible for maintaining your own backups using our export features.
8.2 Data Export
You can export your data at any time in CSV or JSON format. This includes contacts, companies, deals, and activity history.
8.3 Data Portability
We support data portability to help you migrate to another CRM if needed.
9. Email Sending and Compliance
9.1 Email Sending Limits
Email sending limits vary by plan. Excessive sending may be throttled or suspended to prevent abuse.
9.2 Anti-Spam Compliance
You must comply with:
- CAN-SPAM Act (US)
- GDPR (EU)
- CASL (Canada)
- Other applicable anti-spam laws
This includes providing unsubscribe options and honoring opt-out requests.
9.3 Spam Prevention
We monitor for spam activity and may suspend accounts that violate anti-spam policies.
10. Team Members and User Management
As an account owner, you can:
- Add team members up to your plan limit
- Assign roles and permissions
- Remove team members at any time
- Monitor team member activity
You are responsible for your team members' use of SalesHive and ensuring they comply with these terms.
11. Third-Party Integrations
SalesHive integrates with third-party services. When you enable integrations:
- You authorize data sharing with those services
- Their terms and privacy policies apply
- We are not responsible for third-party service issues
- You can disconnect integrations at any time
12. Intellectual Property
12.1 Our IP
SalesHive platform, including software, design, features, and documentation, is owned by UnoHive Technologies and protected by intellectual property laws.
12.2 Your IP
You retain all rights to your data, content, and materials. We do not claim ownership of anything you create or upload.
12.3 License to Use
You grant us a limited license to host, store, and process your data solely to provide the SalesHive service.
13. Warranty Disclaimer
SalesHive is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including but not limited to:
- Merchantability or fitness for a particular purpose
- Uninterrupted or error-free operation
- Data accuracy or completeness
- Security or freedom from viruses
- Results or outcomes from using the service
14. Limitation of Liability
To the maximum extent permitted by law, UnoHive Technologies shall not be liable for:
- Loss of data, profits, revenue, or business opportunities
- Indirect, incidental, special, or consequential damages
- Damages exceeding fees paid in the past 12 months
- Issues caused by third-party services or integrations
- Your violation of laws or third-party rights
- Unauthorized access due to your negligence
15. Indemnification
You agree to indemnify UnoHive Technologies from claims arising from:
- Your use of SalesHive
- Your violation of these terms
- Your violation of laws or regulations
- Content you submit or emails you send
- Infringement of third-party rights
16. Termination
16.1 By You
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
16.2 By Us
We may suspend or terminate your account if you:
- Violate these terms or acceptable use policy
- Fail to pay subscription fees
- Engage in fraudulent or abusive behavior
- Pose a security risk to the platform
16.3 Data After Termination
After account termination:
- You have 30 days to export your data
- Data will be deleted after 30 days
- Backups may be retained for up to 30 additional days
- Some data may be retained as required by law
17. Changes to Service and Terms
We may:
- Update features and functionality
- Modify or discontinue features with notice
- Change these terms with 30 days notice
- Update pricing with advance notice
Continued use after changes constitutes acceptance.
18. Governing Law and Disputes
These terms are governed by the laws of India. Disputes shall be resolved through arbitration in Bhubaneswar, Odisha, or courts in Bhubaneswar, Odisha, India.
19. Entire Agreement
These terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and UnoHive Technologies.
